Does your website comply with the Companies Act?
Monday, January 14th, 2008Although this is fairly old news now it’s worth knowing that companies in the UK must now include certain regulatory information on their websites and in their email footers or they will breach the Companies Act and risk a fine. This legislation actually came into effect before 1st January 2007 however it’s amazing how many websites I see without the required information
According to Out-law.com ( an excellent source for IT and e-commerce legal information) despite widespread opinion you aren’t required to have this information on every single page of your site. Perhaps the reason why you tend to see this on every page of some websites is that a lot of companies put it in a common footer file that is included in every page. To comply with the Companies Act you simply need the appropriate information on a prominent page such as “About Us” or “Legal Information”.
The following format provides a clear indicator for how to present this information on a company website.
“ZXY Enterprises Limited is a company registered in England and Wales with company number 1234567″
Also if company name differs from the trading name then any differences should be explained as we can see below
“ZXY.com is the trading name of ZXY Enterprises Limited.”
If you haven’t dealt with this already and aren’t sure how to go about updating your website then please get in touch and I’ll be happy to advise you.
